Please read these Terms and Conditions carefully before using our website or engaging our services. By accessing our website or using our services, you agree to be bound by these terms. If you disagree with any part of these terms, you must not use our website or services.

1. Definitions and Interpretation

"BUREAUTEK", "we", "us", "our"
Refers to BUREAUTEK Inspection and Training Certification LLC, a company registered in the United Arab Emirates.
"Client", "you", "your"
Refers to any individual or entity that engages our services or uses our website.
"Services"
Refers to all inspection, testing, certification, training, and manpower services provided by BUREAUTEK.
"Website"
Refers to bureautek.com and all associated subdomains.
"Agreement"
Refers to the contract between BUREAUTEK and the Client for provision of services.
"Confidential Information"
Includes all proprietary, technical, business, and client information disclosed during service provision.

2. Acceptance of Terms

By accessing or using our website, or by engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are using our services on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2.1 Service-Specific Terms

Additional terms may apply to specific services, which will be provided in separate service agreements or proposals. In case of conflict between these general terms and specific service agreements, the service-specific terms shall prevail.

3. Services Description

BUREAUTEK provides the following services:

  • Inspection Services: Third-party inspection, vendor inspection, and quality assurance services
  • Testing Services: Non-destructive testing, material testing, and calibration services
  • Certification Services: Personnel certification, equipment certification, and system certification
  • Training Services: Professional training programs including HSE, welding, inspection, and lifting operations
  • Manpower Services: Supply of skilled professionals for inspection, testing, and industrial projects
  • Consultancy Services: Technical consultation and advisory services

Service Limitations

Our inspection and testing services are performed in accordance with applicable standards and our professional judgment, but we do not guarantee absolute detection of all defects or issues. Training services provide education and skills development but do not guarantee employment or specific outcomes.

4. Client Responsibilities

4.1 General Obligations

Clients agree to:

  • Provide accurate and complete information necessary for service delivery
  • Ensure safe access to inspection sites and provide necessary safety equipment
  • Obtain all necessary permits and approvals for our personnel to perform services
  • Provide adequate facilities and resources for training programs
  • Comply with all applicable laws and regulations
  • Make timely payments as per agreed terms

4.2 Safety Requirements

Clients must ensure that all work sites are safe for our personnel. We reserve the right to refuse or suspend services if unsafe conditions exist that could endanger our personnel or equipment.

5. Service Agreements and Quotations

5.1 Quotations

All quotations are valid for 30 days from the date of issue, unless otherwise stated. Quotations are based on information provided by the Client and may be revised if actual conditions differ.

5.2 Service Agreements

Formal service agreements will be executed for all engagements, detailing scope of work, deliverables, timelines, fees, and specific terms. These agreements supersede any prior discussions or correspondence.

5.3 Changes to Scope

Any changes to the scope of work must be agreed in writing by both parties. Additional charges may apply for scope changes.

6. Fees and Payment Terms

6.1 Service Fees

All fees are quoted in UAE Dirhams (AED) unless otherwise specified. Fees are exclusive of VAT and any other applicable taxes, which will be added to invoices as required by law.

6.2 Payment Terms

  • Inspection/Training Services: 50% advance payment, 50% upon completion
  • Manpower Services: Monthly invoicing with payment within 30 days
  • Certification Services: Full payment before certification issuance

6.3 Late Payments

Late payments will incur interest at 1.5% per month from the due date. We reserve the right to suspend services for overdue accounts.

Payment Disputes

Any payment disputes must be raised in writing within 14 days of invoice receipt. Failure to dispute within this period constitutes acceptance of the invoice.

7. Intellectual Property

7.1 Our Intellectual Property

All reports, certificates, training materials, methodologies, and software developed by BUREAUTEK remain our intellectual property. Clients receive a license to use these materials for their intended purpose only.

7.2 Client Intellectual Property

Client information and proprietary data shared with us remains the property of the Client. We maintain confidentiality as outlined in our Privacy Policy.

7.3 Trademarks

The BUREAUTEK name, logo, and all related trademarks are our property. Use of our trademarks requires prior written permission.

8. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information exchanged during service provision. This obligation continues for 5 years after termination of services.

9. Liability and Limitations

9.1 Limitation of Liability

Our total liability for any claim arising from our services shall not exceed the total fees paid for the specific service in question. We shall not be liable for any indirect, consequential, or incidental damages.

9.2 Professional Standards

We perform services with reasonable care and skill in accordance with applicable professional standards. However, we do not guarantee specific outcomes or absolute detection of all issues.

9.3 Force Majeure

Neither party shall be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, government actions, strikes, or pandemics.

Important Limitation

Our inspection reports represent conditions at the time of inspection only. We are not responsible for changes that occur after inspection. Training certification indicates completion of course requirements but does not guarantee competency in all situations.

10. Insurance

We maintain professional liability insurance as required by UAE regulations. Details of our insurance coverage are available upon request for qualified clients.

11. Website Usage Terms

11.1 Acceptable Use

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the website.

11.2 Prohibited Activities

You must not:

  • Use the website in any way that breaches UAE laws or regulations
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to our systems
  • Use automated systems to extract data from our website
  • Impersonate others or provide false information

11.3 Intellectual Property Rights

All content on our website, including text, graphics, logos, and software, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.

11.4 Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of these external sites.

12. Training Services Specific Terms

12.1 Registration and Payment

Training registration is confirmed only upon receipt of payment. We reserve the right to cancel or reschedule training programs with at least 7 days' notice to registered participants.

12.2 Cancellation Policy

  • Cancellation 14+ days before training: Full refund
  • Cancellation 7-13 days before training: 50% refund
  • Cancellation less than 7 days before training: No refund
  • No-shows: No refund, no credit

12.3 Certification

Certificates are issued upon successful completion of training requirements. We reserve the right to withhold certificates for non-payment or unsatisfactory participation.

12.4 Prerequisites

Some training programs have prerequisites. It is the participant's responsibility to ensure they meet these requirements before registration.

13. Inspection and Certification Services Specific Terms

13.1 Scope of Inspection

Inspection scope is defined in the service agreement. Additional findings may require scope changes and additional fees.

13.2 Access and Safety

Clients must provide safe access to inspection sites and all necessary safety equipment. We may refuse to conduct inspections in unsafe conditions.

13.3 Reports and Certificates

Reports and certificates are issued based on findings at the time of inspection. They do not constitute warranties or guarantees of future performance.

13.4 Retention of Records

We retain inspection records for 10 years, in accordance with industry standards and regulatory requirements.

14. Termination

14.1 Termination for Convenience

Either party may terminate service agreements with 30 days' written notice. Fees for work completed up to termination date remain payable.

14.2 Termination for Cause

Either party may terminate immediately if the other party breaches material terms and fails to cure within 14 days of written notice.

14.3 Effects of Termination

Upon termination, all fees for services rendered become immediately due. Confidentiality obligations survive termination.

15. Dispute Resolution

15.1 Negotiation

Parties agree to attempt to resolve disputes through good faith negotiation before pursuing other remedies.

15.2 Mediation

If negotiation fails, parties agree to attempt mediation through a mutually agreed mediator in Dubai.

15.3 Arbitration

If mediation fails, disputes shall be resolved by arbitration in Dubai under the rules of the Dubai International Arbitration Centre (DIAC).

15.4 Governing Law

These terms are governed by the laws of the United Arab Emirates. The courts of Dubai have exclusive jurisdiction.

16. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of modified terms.

17. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with any service-specific agreements, constitute the entire agreement between the parties and supersede all prior agreements and understandings.
